Protecting your private information is our priority. This Privacy Policy explains Patchblox, LLC's ("Patchblox," "we," "us," and "our") data practices, defines our users' ("user," "you," or "your") options, and describes how your information is collected and used by Patchblox.

This Privacy Policy, along with our Terms of Service, governs your use of the Patchblox website at www.patchblox.com (the "Site"), the Patchblox Software and Enterprise Software (the "Software") and any other services we may offer through the Site or Software (collectively, the "System").

Collection of Your Personal Information

Patchblox may collect personally identifiable information from you in connection with your use of the System. You may be required to provide certain personal information to us when you elect to use certain products or services available on the System. These may include:

  • Registering for an account on our System
  • Entering a sweepstakes or contest sponsored by us or one of our partners
  • Signing up for special offers from selected third parties
  • Sending us an email message
  • Submitting your credit card or other payment information when ordering and purchasing products and services on our System

We will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

The Information We May Collect Includes:

  • First and Last Name
  • Email Address
  • Phone Number
  • Job Title
  • Company Name
  • Other information related to your requests and inquiries

If you purchase Patchblox's products and services, we collect billing and credit card information. This information is used to complete the purchase transaction. Patchblox does not store credit card information. Your information is processed and stored by Patchblox's credit card payment processor(s), which include Stripe (https://stripe.com).

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Patchblox's public message boards, this information may be collected and used by others.

Usage Data Collection

Patchblox also collects usage data from the System to help improve the software service and its user experience. This analytics information includes the operating system version, the operating system architecture (32-bit vs 64-bit), .NET version, installed Patchblox Software version, exceptions generated by the Software, and the number of times a Software feature has been used on the device the Software is installed on.

In addition, Patchblox also collects several obfuscated data elements required for license activation that include a hash of the domain, hash of the username and hash of the machine name the Software is installed on. Enterprise Software customers may choose to opt-out from sharing the analytics information, but obfuscated data is still required to be collected for Patchblox's license activation and validation processes.

Use of Your Personal Information

Patchblox collects and uses your personal information to provide you with services and products, and also to collect information that is necessary for the System to work properly.

We use personal information for a variety of purposes related to our business, including but not limited to:

Providing Services and Support

Performing the essential functions of the System including responding to inquiries, fulfilling orders and requests, processing payments, providing support and troubleshooting, and communicating with users about their use of the System or regarding a user initiated inquiry on the System.

Communicating with Users About Products or Services

Sending or initiating direct marketing programs, such as newsletters or information about new products or services we are offering.

Personalizing User Experiences on Our System

Tailoring content on the System based on user location, preferences, and other personalization factors.

Analytics and System Improvement

Tracking information about your visits to our Site or use of the System to allow us to provide better service; using certain online preferences in the aggregate across all users to evaluate the System and develop additional products and services to offer.

Other Purposes

Other purposes necessary to carry out our obligations under this Privacy Policy or our Terms of Service.

Sharing Information with Third Parties

Patchblox does not sell, rent or lease its customer lists to third parties. Patchblox may disclose your personal information to third parties for the following purposes:

  • With Permission: When we have the individual's permission to make the disclosure
  • Compliance with Law: Patchblox may disclose your personal information, without notice, if requested by law enforcement, required to do so by law, or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Patchblox; (b) protect and defend the rights or property of Patchblox; and/or (c) act under exigent circumstances to protect the personal safety of users of Patchblox or the public
  • Business Sale or Transfer: When the disclosure is reasonably related to the sale or other disposition of all or part of the business or assets
  • When Publicly Available: We may disclose personal information if it is publicly available
  • With Business Partners: We may disclose personal information for use in Patchblox's or Patchblox's business partners' advertising, marketing, or other business purposes in connection with the System. In addition, Patchblox may disclose information to a third party, agent or business partner in order to perform services, to maintain or develop our System, to integrate in connection to the System or for other contracted promotional opportunities provided to our users

We may also share information, in the aggregate, regarding your online browsing preferences to evaluate our products or allow the third parties we work with to better serve our users.

Google Analytics

We use Google Analytics to better understand who is using the Site and how people are using it. Google Analytics uses cookies to collect and store information such as Site pages visited, places where users click, time spent on each Site page, Internet Protocol address, type of operating system used, and location-based data. Tracking User Behavior

Patchblox may keep track of the websites and pages our users visit within the System in order to determine what Patchblox services are the most popular. This data is used to deliver customized content and advertising within the System to customers whose behavior indicates that they are interested in a particular subject area.

Retargeting

Patchblox uses Google Ads remarketing services to advertise on third party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven't completed a task on our site, for example using the contact form to make an inquiry. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits. Of course, any data collected will be used in accordance with our own privacy policy and Google's privacy policy.

You can set preferences for how Google advertises to you using Google Ad Preferences page at https://www.google.com/settings/ads, and if you want to you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

Automatically Collected Information

The Site collects information about your computer hardware and software may be automatically collected by Patchblox. This information can include: your IP address, browser type, domain names, access times and referring website addresses. Devices with installed Software may also be tracked by Patchblox (such as via Internet Protocol address) to locate where on the Internet that computer is located. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the System.

Use of Cookies and Similar Technologies

The System uses "cookies" and similar tracking technologies to help personalize your online experience and improve our services. This section explains what cookies are, how we use them, and how you can manage your cookie preferences.

What Are Cookies?

A cookie is a small text file that is placed on your device by a web server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.

Types of Cookies We Use

Essential Cookies (Strictly Necessary)

These cookies are necessary for the System to function and cannot be switched off in our systems. These cookies allow us to count visits and traffic sources so we can measure and improve the performance of our System. As a result, while we strive to protect your personal information, you acknowledge that: (a) there are security and privacy limitations inherent to the Internet which are beyond our control; and (b) security, integrity, and privacy of any and all information and data exchanged between you and us through the System cannot be guaranteed.

Children Under Thirteen

The System is not designed for children, and Patchblox does not knowingly collect personally identifiable information from children under the age of thirteen.

Email Communications

From time to time, Patchblox may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our System, we may receive a notification when you open an email from Patchblox or click on a link therein. Emails from Patchblox may contain web beacons, such as clear GIFs or pixel tags, that allows Patchblox to capture analytic information about email deliverability and open rates.

If you would like to stop receiving marketing or promotional communications via email from Patchblox, you may opt out of such communications by clicking on the unsubscribe button.

Third Party Websites and Links

Our System may contain links to other websites. These websites may have privacy policies different than our Privacy Policy. The System may also contain certain social media icons or widgets. Although you can view the material we have linked to, you may have to create an individual account or register to use these third-party social media sites to use interactive features. Any interaction on social media or other third-party websites is governed not by this privacy policy but by the terms of use and privacy policy of the particular platform.

Changes to this Statement

Patchblox reserves the right to change this Privacy Policy from time to time and will mark new versions with a corresponding effective date. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our Site, and/or by updating any privacy information on this page. Your continued use of the System after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.

Your California Rights Policy

Section 1798.83 of the California Civil Code permits California residents to request from a business, with whom the California resident has an established business relationship, certain information about the types of personal information the business has shared with third parties for those third parties' direct marketing purposes and the names and addresses of the third parties with whom the business has shared such information during the immediately preceding calendar year. You may make one request each year by emailing us at privacy@patchblox.com.

European Data Protection Rights (GDPR)

If you are a resident of the European Economic Area (EEA), United Kingdom, or Switzerland, you have certain data protection rights under the General Data Protection Regulation (GDPR). Patchblox aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal information.

  • Right to Access: You have the right to request copies of your personal information
  • Right to Rectification: You have the right to request correction of inaccurate or incomplete information
  • Right to Erasure: You have the right to request deletion of your personal information under certain circumstances

  • Right to Data Portability: You have the right to request transfer of your data to another organization or directly to you

Legal Basis for Processing (EEA/UK Users)

  • Legitimate Interests: Processing necessary for our legitimate business interests, such as improving our System and preventing fraud

Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When we no longer need your personal information, we will securely delete or anonymize it.

Your information may be transferred to and processed in the United States or other countries where Patchblox or our service providers operate. If you are located in the EEA, UK, or Switzerland, we ensure appropriate safeguards are in place for such transfers, including Standard Contractual Clauses approved by the European Commission.

Supervisory Authority

If you are located in the EEA, UK, or Switzerland, you have the right to lodge a complaint with your local data protection supervisory authority if you believe we have not complied with applicable data protection laws.

Do Not Track and Global Privacy Control

Some browsers include a "Do Not Track" (DNT) feature that signals to websites that you do not want your online activities tracked. The System does not currently respond to DNT signals because there is no universal standard for how to interpret these signals.

However, we do honor Global Privacy Control (GPC) signals for users in applicable jurisdictions. If you enable GPC, we will treat it as a request to opt out of the sale or sharing of your personal information where applicable under privacy laws.
